Former Nairobi Governor Mike Sonko has moved to court seeking to block the planned degazettement of the Capitol Hill Police Station, raising concerns over security and the potential impact on ongoing legal processes.

Urgent legal action

Sonko said he had instructed his lawyers to file a petition under urgency to challenge the decision, citing several constitutional provisions including Articles 22, 23, 10, 247 and 258.
In his statement, he argued that the move to remove the police station from the official list of operational facilities would undermine safety in Nairobi’s Upper Hill area, where the station is located.
“As a resident of Upper Hill… we cannot and will not allow the security of Upper Hill to be compromised,” Sonko said.

Security concerns in Upper Hill

Sonko described Upper Hill as a critical hub that hosts key national institutions, including courts, hospitals, banks, government offices, and diplomatic missions.

The area is home to facilities such as Milimani Law Courts, the Office of the Director of Public Prosecutions, and major hospitals, alongside financial institutions and international organisations.

He warned that removing or downgrading the police station could expose the area to heightened security risks, affecting not only residents but also businesses and state institutions operating within the district.

Link to ongoing legal cases

Beyond general security concerns, Sonko also linked the issue to his ongoing court cases. He noted that the Capitol Hill Police Station holds key records, including occurrence book (OB) entries and evidence tied to matters currently before the courts.
According to him, some officers from the station have already testified, while others are expected to appear in court, raising questions about continuity if the station is closed.
He added that there is a possibility courts may need to visit the station as part of proceedings, making its status significant to the handling of cases.

The planned degazettement is part of a broader restructuring process within the police service aimed at redistributing resources and improving efficiency.

Reports indicate that officers stationed at Capitol Hill have already been redeployed, and members of the public with pending cases or exhibits have been asked to collect them as the process moves forward.
The development has also drawn attention from residents and stakeholders in surrounding areas, some of whom have raised concerns about a possible security gap if the station is fully closed.
