In a move that captivated observers and underscored the escalating tensions around recent protests, Embakasi East Member of Parliament, Babu Owino, known for his fiery political presence, made his highly anticipated debut as an advocate yesterday.
Stepping before Magistrate Alego at Milimani Court, Owino represented Suleiman Wanjau Billali and Robert Otiti Elwak, two individuals arrested in connection with the June 25th anniversary demonstrations. The duo faces charges of "Publication of False Information" contrary to section 23 of the Computer Misuse and Cybercrimes Act No. 5 of 2018, specifically for allegedly telling "Gen Zs to go to State House".
“I had the honor of standing before the bench to represent these individuals who were arrested for challenging the government,” he said.

Owino, reflecting on his first court appearance, stated, "It was a powerful reminder of the vital role the legal profession plays in defending rights, upholding justice, and ensuring that every voice, even those in opposition, is heard. This is only the beginning of a long journey, and I remain committed to the cause of justice and the rule of law.
The court proceedings revealed a heated exchange, with the defense passionately arguing against the extended detention of Billali and Elwak. Owino highlighted a significant constitutional concern: the accused were arrested on June 24th but only presented in court on June 26th, allegedly infringing on their rights under Article 49 of the Kenyan Constitution, which mandates that an arrested person be produced before a competent court within 24 hours.
Furthermore, he asserted that they were denied a police bond despite being well-known individuals.
The Investigating Officer (IO) had sought to detain the accused for an additional 10 days via a miscellaneous application. Owino vehemently opposed this, labeling the IO's approach a "fishing expedition" and an "abuse of the court process".

He argued that the State was seeking to arrest first and then investigate, which he described as doing "things in a very opposite way" contrary to the rules of natural justice.
After hearing arguments from both sides, the court made an interim ruling. While not granting immediate free bond, the judge ordered that Suleiman Wanjau Billali and Robert Otiti Elwak be held at Capitol Hill Police Station until a full ruling is delivered today, June 27th, 2025. The court also took judicial notice of the sentiments presented and assured that any needed medication would be accorded to the suspects as a human right.
This dramatic legal debut by Babu Owino has added a new dimension to the ongoing public discourse surrounding citizen protests and the role of the legal system in upholding fundamental rights.
