A lawyer representing the family of the late Albert Ojwang has sounded the alarm over visible injuries on his body, raising fresh concerns about the circumstances surrounding his death in police custody.
Speaking to the press outside City Mortuary on Monday, the lawyer described extensive physical trauma, including swelling and bruising, particularly on Ojwang’s head, hands, and shoulders.
“The head was swollen all over—especially the frontal part, the nose, and the ear,” the lawyer noted, adding that blood was visibly seeping from Ojwang’s nose and mouth during the viewing.
Ojwang, a teacher, died at Nairobi’s Central Police Station shortly after his arrest in Homa Bay over the weekend, reportedly for a “derogatory” post online.
His death has sparked national outrage and renewed demands for police accountability.
The family’s lawyer said the injuries raise suspicion of possible foul play and urged authorities to conduct an independent and transparent investigation into what transpired between Ojwang’s arrest and his death.
“We need to gather and piece together the facts so that by the time the autopsy is conducted, we will have a clear picture of what caused Albert’s death,” the lawyer said.
Although an autopsy was expected to take place on Monday morning, it was postponed following a meeting at the Chief Government Pathologist’s office.
The legal team was advised to return later in the day, with the hope that the procedure would proceed at 2 p.m.
The lawyer also revealed that the family had been kept largely in the dark about Ojwang’s fate. “He was arrested on Saturday around 3 p.m. in Homa Bay.
The next information the family received, after making follow-up inquiries, was that he had died,” he said.
While police initially claimed that Ojwang died while receiving treatment at Mbagathi Hospital, the lawyer challenged this narrative.
“From the information we have, he died in custody and was transported directly here [to the mortuary],” he asserted.
As of Monday afternoon, the autopsy had yet to be conducted, and numerous questions remain unanswered about the cause of death, the legality of the arrest, and the conditions of his detention.
