Content creator Peter Kimani, popularly known as Menelik Kimani /HANDOUTContent creator Peter Kimani, popularly known as Menelik Kimani, has been released days after his arrest over a viral TikTok video in which he challenged William Ruto and made remarks that authorities described as threatening.
Kimani was arrested on February 26 by detectives from the Directorate of Criminal Investigations (DCI) at a hideout in the Gachage area of Kiganjo in Gatundu South subcounty.
According to the DCI, allegedly wnet into hiding after posting the clip.
The video, which circulated widely on social media, reportedly contained statements referencing a coup and what he termed a spiritual war.
On Sunday Kimani resurfaced on TikTok through a newly created account, confirming that he had been freed on Friday.
However, he said his mobile phone and original TikTok account remain in police custody.
“Hi guys, it’s Menelik Kimani. I was arrested on Thursday and released on Friday and I am at home. Just a small problem, my phone and my TikTok account are still with the DCI so, I cannot use them but I have created a new account where you can search me and follow me,” he said in a video message.
The DCI had earlier stated that the arrest followed a forensic review and intelligence-led operation after the video was flagged as containing content deemed a threat to public safety and order.
Detectives said they tracked his digital footprint before locating him.
In a statement, the agency reiterated that while freedom of expression is protected under the constitution, it is not absolute where it infringes on the rights and safety of others.
“The enjoyment of freedom of expression should not be used as a tool to promote or justify the violation of the rights of others,” the DCI said, adding that it would continue monitoring digital platforms to curb hate speech, incitement and the promotion of violence.
The DCI warned that law enforcement will not hesitate to act against individuals who use social media to disrupt the peace.
"The directorate further reiterates that no effort will be spared in addressing any irresponsible use of social media, especially where there is a threat to peace and security," it said.
