The hearing of an impeachment trial against Kericho Governor Eric Mutai has begun.
As per the tradition, senators convened for a closed-door preparatory meeting to set ‘ground’ rules for the management of the investigation.
In his communication, Speaker Amason Kingi highlighted that the importance of the pre-hearing session.
“This is to ensure the process is conducted seamlessly and concluded within the set period and in line with requirements set out in the county governments Act and the senate standing orders,” he said.
During the session, the parties in the matter, including the public and the media were ordered out of the chamber.
“Any forms of broadcast from the chamber shall cease forthwith,” Kingi ruled.
Mutai is set to know his fate tomorrow when the senators take a final vote following the conclusion of the hearing.
The matter is being heard on plenary after a bid to form a committee was defeated.
“The governor is accused of gross violation of the Constitution and other laws with misappropriation, misallocation and illegal drawing of county revenue and county finances, misappropriation or abetting misappropriation of publicly raised funds,” he said.
Monday’s session will end at 7:30pm.
Following the pre-hearing session, there will be a recital of the mandate of the Senate, rules of procedure and hearing programme.
Thereafter, the MCAs and counsels representing the county assembly will introduce themselves.
The governor and his counsels will also introduce themselves.
The charges will then be read out.
As per the programme, the county assembly will be the first to give the opening remarks for 30 minutes followed by the governor.
Between 12pm to 1pm, the evidence by the County Assembly (evidence of witnesses, if any, cross-examination and re-examination) will follow.
A total of 3 hours for the evidence of the County Assembly and a total of 2 hours for cross-examination.
The House will then break for lunch and resume at 2:30pm for the continuation.
Today’s session will conclude with questions or requests for clarification by senators.
