The High Court has allowed politician Rose Mbithe and her two children, Angela Mulwa and Chris Mulwato, to cross-examine her ex-husband, David Ndeetei, over the authenticity of his alleged affidavit opposing their release on bail in the Dr.Victoria Mutiso murder case. The court said the move was necessary to safeguard the accused persons’ right to a fair hearing and liberty. The accused questioned how Ndeetei could have sworn the affidavit while reportedly hospitalized.
