The Court of Appeal has lifted orders blocking implementation of the Kenya–US health cooperation framework, allowing the programme to proceed pending a hearing and determination of the intended appeal. The Court set aside High Court conservatory orders issued in December 2025, after senator Okiya Omtatah raised constitutional concerns relating to data protection, public finance and devolution.  The government argued that suspending the framework would disrupt treatment for about 1.4 million Kenyans receiving support for HIV, tuberculosis, malaria and other infectious diseases.
