The Director of Public Prosecutions (DPP) has secured a 20-year prison sentence against a 65-year-old Kisumu man convicted of defiling a 12-year-old child.

According to the DPP, the man was convicted by the Kombewa Magistrate’s Court of defilement under Section 8(1) and (3) of the Sexual Offences Act.

The DPP said the prosecution had also presented an alternative charge of committing an indecent act with a child under Section 11(1) of the Act.

“The court heard that the offence occurred in March 2025 in Seme Sub-county, Kisumu County, after the man allegedly lured the child to his house while she was returning from school at about 4 pm,” the DPP stated.

The DPP said the accused denied both charges in his defence through an unsworn statement.

The prosecution called five witnesses to testify in support of the case. According to the DPP, clinical findings presented to the court were consistent with defilement.

The DPP said the trial court found the accused’s defence that he had been framed to be shallow and unconvincing against the prosecution evidence.

After evaluating the evidence, the court found that the prosecution had proved the charge beyond reasonable doubt.

The DPP said the court subsequently convicted the man on the main charge of defilement under Section 8(1) and (3) of the Sexual Offences Act and sentenced him to 20 years in prison.

The DPP said the conviction and sentence followed the prosecution’s presentation of evidence supporting the charge.
