The High Court is set to rule on a petition challenging the legality of the national tallying and verification of presidential election results after they have been declared at constituency level.
The petition, filed by Busia Senator Okiya Omtatah, challenges the establishment and operation of the National Tallying Centre.
It argues that the Constitution does not allow the Independent Electoral and Boundaries Commission (IEBC) to re-tally, re-verify or alter presidential results already declared by constituency returning officers.
He has also challenged provisions of the Elections Act and election regulations that provide for further verification and tallying of presidential results at the national level.
The petitioner wants the court to declare the disputed provisions unconstitutional and quash them.
