Nyachae is accused of theft of Sh1,226,036 on diverse dates between March 28, 2019, and September 28, 2021, in Kisii county.
The charge was brought under Section 268(1) as read with Section 275 of the Penal Code, which relates to the offence of stealing.
According to the charge sheet, the funds were the property of Sansora Group Limited and was allegedly stolen during the period specified by the prosecution.
Nyachae appeared before Principal Magistrate Caroline Nyaguthii at the Milimani Law Courts in Nairobi on Friday, September 11, 2026, following his arrest.
When the charges were read to him, he denied the allegations.
Through his lawyers, Nyachae asked the court to release him on bail, urging the magistrate to exercise her discretion in determining the terms of his release.
“In granting bail we are asking for the court to exercise discretion and we can tell you without doubt that the person before you belongs to distinguished family,” his lawyer told the court.
The court ultimately released the accused person with several set conditions.
"The court will exercise it's discretion in favor of the accused person who is presumed innocent at this juncture in granting a bond of Sh200,000 with a similar surety of the same amount," the magistrate ruled.
Alternatively, he was freed on a cash bail of Sh50,000 with two contact persons.
The court also ordered the defence be supplied with the charge sheet, witness statements and other relevant documents.
The bail terms allow him to remain out of custody as the case proceeds before the court.
Nyachae is the son of the late Simeon Nyachae, who served in various senior government positions, including as a Cabinet minister.
The former minister was also a prominent politician from Kisii who held several government portfolios during his political career.
The matter will return for a mention on September 29 for pre-trial directions.
