A 92-year-old man has been sentenced to life imprisonment after being convicted of defiling a 10-year-old child in Mukurwe-ini, Nyeri County.

Samuel Kimiti Ndoro was sentenced on September 10, 2026, by Principal Magistrate Agde Savai Eddah at the Mukurwe-ini Law Courts.

Ndoro faced one count of defilement contrary to Section 8(1) as read with Section 8(2) of the Sexual Offences Act No. 3 of 2006. He also faced an alternative charge of committing an indecent act with a child contrary to Section 11(1) of the Act.

According to the Office of the Director of Public Prosecutions (ODPP), the prosecution established that Ndoro was known to the child and was a family friend.

The prosecution, led by Principal Prosecution Counsel Elizabeth Waruguru and Prosecution Counsel Sarah Kitui, told the court that Ndoro led the child to a secluded area within his compound, where he sexually assaulted her.

The prosecution further presented evidence that Ndoro subsequently gave the child money and threatened her against disclosing what had happened.

The matter came to light after Ndoro reported the child to her grandmother, alleging that she had stolen from him. According to the prosecution, Ndoro feared that the child would disclose the incident to her grandmother.

When the grandmother questioned the child about the money in her possession, she disclosed that Ndoro had given it to her after the assault. She also disclosed an earlier incident in which she said she had been defiled by Ndoro.

The prosecution called five witnesses and presented medical and other evidence in support of its case. The evidence included the balance of the money allegedly given to the child after she acknowledged that she had spent part of it.

The court found the child's evidence credible and sufficiently corroborated. It also established that she had positively identified Ndoro as the person who assaulted her.

The court rejected Ndoro's defence, citing inconsistencies in his account and finding that his evidence did not raise reasonable doubt against the prosecution's case.

Having considered the totality of the evidence, the court found Ndoro guilty of defilement and sentenced him to life imprisonment.

The ODPP said the sentence takes effect from the date Ndoro was first arraigned and detained.
