DPP directs bribery charges against a prosecutor in Nairobi

The Director of Public Prosecutions (DPP) has directed that a prosecutor based in Madaraka Law Court be formally charged with bribery following an investigation by the Ethics and Anti-Corruption Commission (EACC).

The decision comes after an independent review of the evidence, which the DPP described as “sufficient and credible” to sustain criminal charges.

The accused is set to be arraigned before a court of competent jurisdiction to answer three counts of receiving a bribe under the Bribery Act.

The move signals a continued crackdown on corruption within the criminal justice system, reinforcing the principle that no individual, regardless of office or rank, is above the law.

“The Office of the Director of Public Prosecutions will not hesitate to take decisive action against any officer who undermines the integrity of the criminal justice system. Upholding the rule of law and public trust is paramount,” the DPP stated.

The EACC initially forwarded the inquiry file after receiving allegations that the prosecutor solicited and accepted payments in exchange for favourable actions in ongoing cases.

Following a thorough review, the ODPP concluded that there was enough evidence to justify prosecution, marking a significant step in reinforcing accountability among legal officers.

“The administration of justice depends on the integrity of those entrusted with upholding it. Corruption of any form cannot be tolerated, and swift action must follow credible allegations,” the DPP added, underlining the office’s commitment to transparency and accountability.

The cases of corruption involving prosecutors, while rare, have a profound impact on public confidence in the justice system.

By authorising the charges, the DPP aims to deter similar misconduct and restore trust in the administration of justice.

The ODPP reaffirmed that all proceedings will adhere to constitutional provisions and the public interest, stressing that the enforcement of anti-corruption measures is central to maintaining an effective and accountable justice system.

The arraignment is expected to take place in the coming days, with the court tasked with hearing the charges and determining the next steps in the legal process.
