Former Kiambu Governor Ferdinand Waititu in Milimani Magistrate court on Tuesday, November 18, 2025/JAMES GICHIGIA Nairobi court has reaffirmed earlier bond terms granted to former Kiambu Governor Ferdinand Waititu in the case where he is charged with offensive conduct against the State.
Appearing before Principal Magistrate Rose Ndombi on Tuesday, November 18, 2025, the prosecution indicated its readiness to proceed with the matter, which had come up for mention mainly to set a hearing date.
The magistrate confirmed that Waititu would continue to be released under the bond conditions previously granted in the case, subject to complying with all additional bond terms issued in his other ongoing matters.
“This court has no objection to the accused being released on the earlier issued bond terms, subject to his compliance with other bond conditions from other courts,” she ruled.
However, Waititu’s defence team informed the court that they were yet to receive complete pre-trial documents from the Investigating Officer (IO), documents they said were necessary for proper preparation.
Magistrate Ndombi directed his lawyer to urgently liaise with the IO to ensure full disclosure without further delay.
The court then scheduled January 15, 2025, as the hearing date.
The trial, which was filed in 2024, has yet to commence.
According to the charge sheet, Waititu is facing charges of making offensive remarks at Ruiru Stadium in Kiambu County on September 29, 2024.
He is alleged to have uttered offensive words and made comments linking parliamentary impeachment motions to potential attempts to remove senior state officials.
Waititu denied the charges and was released on a Sh50,000 bond.
During the mention, the court was also briefed on the status of Waititu’s separate Anti-Corruption case before Justice Lucy Njuguna, in which he was convicted in February 2025.
The ex-Kiambu boss was ordered to pay a bank guarantee bond of Sh53 million or continue serving 12 years in prison pending the hearing of his appeal.
Though his initial bid for bail pending appeal was dismissed, Justice Njuguna eventually granted him a Sh53 million bond on July 31, 2025.
Waititu informed the magistrate’s court that he has now secured a person willing to deposit the bank guarantee required to secure the High Court bond.
The lower court also advised him that once he settles the Sh53 million, he will be free under the High Court terms, noting that his earlier bond in the offensive conduct case already remains active.
His lawyer added that the administrative processes connected to the bank guarantee are ongoing.
