
The high court is today expected to deliver a ruling in a case in which the Inspector General of Police has sought the dismissal of a case filed by the Law Society of Kenya touching on the whereabouts of two Kenyans alleged to be missing.
The last time the matter was in court, the IG through advocate Paul Nyamodi told Justice Bahati Mwamuye that since the court had already issued orders for the production of the missing persons—whether dead or alive—there was nothing further for the court to determine.
Nyamodi emphasised that both the IG and the Directorate of Criminal Investigations (DCI) had stated that the individuals were not in their custody.
It is alleged that one of the missing individuals, Kevin Muthoni remains unaccounted for and is listed as the eighth petitioner in the case.
The court also heard that the Law Society of Kenya had sought for DNA samples undertaken on February 4, 2025, to be expedited to ascertain the Identities of 14 unknown bodies found at Nairobi Funeral Home (formerly city mortuary)
"DNA samples have been taken and we are anxious to confirm if one of the petitioners has been found dead or alive," said Senior Counsel Martha Karua.
The two alleged missing Kenyans are Muthoni and Steven Kavingo.
Those who were released are Peter Muteti, Bernard Kavuli, Billy Mwangi, Gideon Kibet and Rony Kiplagat.
LSK at the time reiterated that they still don't have answers regarding their whereabouts.
"The duty bearers have failed to produce the two in court and the only way is that they must be held accountable because they have access to public resources and they cannot argue that they don't know where they are," she said.
These are the issues the court is to rule on today.
