The High Court is today expected to proceed with the murder hearing of the late MP George Muchai.

Muchai is said to have been murdered on the morning of February 7, 2015. He was shot dead together with his bodyguard and driver.

Those on trial over his murder are Eric Isabwa alias chairman, Raphael Kimani alias Kim Butcher, Mustapha Kimani alias Musto, Stephen Astiva alias Chokore, Jane Wanjiru alias Shiro, Margaret Njeri and Simon Wambugu.

They have however denied the charges.

A Forensic examiner who has since testified in the case was unable to give details regarding the shooting.

Chief Inspector Jackson Cheboi told Trial Judge Kanyi Kimondo that from the video footage presented in court, he could not tell the time when Muchai’s vehicle came to a standstill.

He said the footage was not clear owing to the technology that was being used at the time.

He said he does not know the vehicle that brought the assassins along Kenyatta Avenue and Uhuru Highway intersection where Muchai was allegedly shot.

Separately, the court is to mention a case in which impeached Deputy President Rigathi Gachagua was sued over utterances he allegedly made on NIS boss Noordin Haji.

The purpose of the mention is to fix a ruling date on the matters raised in the case. 

The petition was filed at Milimani High Court seeking to compel the National Cohesion and Integration Commission to investigate Gachagua over the alleged utterances.

Bikeri in his petition now wants Gachagua probed saying the remarks "were untruthful, inciting and unlawful, and fall against the threshold expected of a Public Officer under the Articles 73 and 75 of the Constitution as read with the Leadership and Integrity Act". 

"The 1st Respondent (NCIC) has the prerogative and responsibility to investigate offences prescribed under the National Cohesion and Integration Act, including remarks which have the potent of creating discord, incitement to violence and advocacy to hatred against other public officers," Bikeri said.

Separately, the High Court will also mention a case in which Oil tycoon Yagnesh Devani challenged his prosecution in the Sh7.6 billion graft case. 

He has since been charged with fraudulently disposing of mortgaged petroleum products in September 2007 and is out on cash bail of Sh5 million.
