The High Court has found four men guilty of murdering former Kabete MP George Muchai and his three companions in a 2015 shooting in Nairobi.

Justice Kanyi Kimondo convicted Eric Mungera Isabwa, Raphael Kimani Gachii, Mustafa Kimani Anyoni and Stephen Astiva Lipopo after finding that the prosecution had proved the murder charges against them beyond reasonable doubt.

The four were facing four counts of murder over the deaths of Muchai, his two police bodyguards, Constable Samuel Kimathi Kailikia and Constable Samuel Lekakeny Matanta, and his driver, Stephen Ituu Wambugu.

In his judgment, Justice Kimondo said the prosecution had established that the four accused jointly committed the murders on the night of February 6 and 7, 2015, along Kenyatta Avenue in Nairobi.

“In the upshot, the Republic has proved beyond any reasonable doubt that on the night of 6th and 7th February 2015 along Kenyatta Avenue within Nairobi, the four accused persons jointly murdered Hon George Mukuru Muchai, police constable Samuel Kimathi, police constable Samuel Lekakeny and Stephen Ituu,” the judge ruled.

“I therefore find all the four accused persons guilty on all the four counts of murder and convict them accordingly,” he added.

The judgment follows a prosecution case in which several witnesses were called to testify before the High Court.

Justice Kimondo had in September 2025 ruled that the four had a case to answer after finding that the prosecution had established a prima facie case against them.

Three other people who had initially been charged alongside them — Jane Wanjiru Kamau, Margaret Njeri Wachiuri and Simon Wambugu Gichamba — were acquitted in the murder proceedings after the court found that the evidence was insufficient to require them to defend the charges.

During the trial, the prosecution presented evidence concerning the events leading to the killings and the alleged involvement of the four accused.

One prosecution witness, police officer Sergeant Moses Otiu Opiyo, previously testified that Muchai and the three other occupants of his vehicle were shot at close range. The witness also linked a G3 rifle recovered during the investigation to a firearm that had earlier been stolen from a police officer.

Justice Kimondo also considered evidence concerning a series of carjackings and robberies reported in Nairobi in the hours preceding the attack on Muchai.

The defence teams contested the prosecution's evidence and denied the allegations against their clients during the trial.

The court nevertheless found that the evidence presented by the prosecution met the threshold required for a criminal conviction.

Muchai was serving as Kabete MP when he was killed. He was attacked along Kenyatta Avenue together with his two police bodyguards and his driver on February 7, 2015.

The murder proceedings are separate from a robbery-with-violence case arising from offences committed during the same period.

In that separate case, the four men were convicted of robbery with violence and were sentenced to death by Milimani Chief Magistrate Lucas Onyina in April 2026.

The robbery case involved three robbery incidents on the nights of February 6 and 7, 2015, during which property valued at about Sh1.1 million was stolen.

The latest judgment establishes the four men's criminal liability for the deaths of Muchai, his two bodyguards and his driver.

The four will now face sentencing following their mitigation Pleas.
