The Director of Public Prosecutions (DPP) has approved a murder charge against Kimutai Maritim in connection with the death of Dr Victoria Nthunya Mutiso.

The Office of the Director of Public Prosecutions (ODPP) said Maritim will be charged alongside Rose Mbithe, her daughter Angela Mulwa, her son Chris Mulwa and Police Constable Elijah Kibelion Kimoi.

The five suspects are expected to appear before the High Court for plea-taking on September 29, 2026, following a directive by Justice Alexander Muteti.

The approval of the charge against Maritim brings to five the number of suspects set to face murder charges in the case, the ODPP said in a statement on Wednesday.

Maritim was arrested on August 22, 2026, after he allegedly attempted to visit suspects detained at Pangani Police Station.

According to the ODPP, he was reportedly intercepted while attempting to deliver a loaf of bread and a packet of milk to the detainees.

During earlier court proceedings, investigators told the court that Maritim was allegedly linked to the planning of the offence.

Investigators also told the court that he could assist in tracing other suspects who remain at large.

The ODPP said the prosecution has also indicated that three additional suspects arrested in Uganda in connection with the murder will return to court on October 1, 2026.

The three are Police Constable Collins Bett Kilangat, Pius Muiruri Mbugua and Samuel Karanja Gathoni.

The trio were arrested on August 29, 2026, at Kyanja Heights Flats in Nakawa, Kampala, before being returned to Kenya.

They have been detained for 30 days to allow investigations to be completed.

The ODPP said the prosecution team is led by counsels Jalson Makori and Pauline Muthuri.

The murder case now has five suspects expected to face charges before the High Court, while the three suspects arrested in Uganda remain in custody pending further court proceedings.

The ODPP's latest development follows earlier proceedings in which investigators outlined their alleged links to the offence and the possible role of Maritim in helping trace other suspects who remain at large.

The five suspects are expected to take plea on September 29, 2026, while Kilangat, Mbugua and Gathoni are scheduled to return to court on October 1, 2026.
