The buyer of the government’s Safaricom shares can voluntarily transfer them back to the government following a court ruling that the sale was unconstitutional. Lawyer Yusuf Aboubakar says if the buyer refuses, the court can order the shares transferred back without requiring the buyer’s signature.

Yusuf says a refund would only be possible if the buyer purchased the shares without knowing the legal consequences. He adds that no refund would be due if the buyer conducted due diligence, understood the risks and proceeded with the purchase.
