Dr Victoria Mutiso./FILEThe Director of Public Prosecutions (DPP) has decided to charge politician Rose Mbithe Ndeti and her two children with the murder of psychiatrist Dr Victoria Nthunya Mutiso.
The DPP informed the court on Monday that a murder case had been registered at the Nairobi High Court against Mbithe and her children, advocates Chris Mulwa and Angela Mulwa.
There was drama at Milimani Law Courts on Monday after lawyer Angela Mulwa was re-arrested outside the courts after Senior Resident Magistrate for Milimani Law Courts, Joan Mati, approved the application filed by the DPP.
The development comes days after the High Court granted Angela and her co-accused a cash bond of Sh1 million each, allowing them to secure temporary freedom after they were arraigned over allegations of possessing a stolen Range Rover Sport valued at Sh15 million.
Angela's defence team, led by city lawyer Danstan Omari, had earlier opposed the state's bid to have the case moved to another court, insisting that it should continue before the current judicial officer.
Omari argued that his client had already presented herself before the court and was out on bond. He also questioned the move to transfer the matter, saying it could affect her ability to represent her clients in a related case.
The lawyer further urged the State to present a properly drafted charge sheet on Tuesday, noting that the court had allowed investigators 21 days to complete their probe but that the period had elapsed without substantive evidence being presented.
“The state was granted 21 days to do the investigation. We expect the state to come tomorrow with the charges. I don't know which court it is in, but they were granted 30 days,” Omari said.
He added: “This has two files. So we completely object to that application. But this file will be prematurely transferred before you apply your mind to the evidence that we have.”
The prosecution, led by Deputy Director of Public Prosecutions Jalson Makori, said the decision followed the conclusion of preliminary investigations by the Directorate of Criminal Investigations (DCI) into Dr Mutiso's death.
Following the decision to charge the three suspects, the DPP withdrew an application seeking additional days to detain Angela Mulwa pending the completion of investigations.
Mbithe and Chris Mulwa have also been in custody while assisting investigators with the ongoing probe.
Dr Mutiso, a psychiatrist and former Director of the African Institute of Mental and Brain Health, was fatally shot in Nairobi on July 29, 2026.
The court heard that preliminary investigations established that Dr Mutiso was involved in a land dispute that was pending before a court in Machakos.
Before her death, Dr Mutiso had reported an incident in which two armed individuals riding a motorcycle allegedly confronted her while she was driving in Nairobi.
The assailants allegedly pointed a firearm at her, but she managed to escape and later reported the incident at Kilimani Police Station.
The DPP said the decision to charge the three suspects was based on evidence gathered during the investigations linking them to the alleged offence.
A pistol allegedly used in the attack, a motorcycle and a car were recovered during ongoing operations.
Police have linked the murder to a longstanding land dispute in the Mlolongo area.
According to the DCI, the killing was carried out with military-style precision, but investigators responded with an equally intensive operation grounded in forensic science, intelligence gathering, digital evidence and inter-agency collaboration.
One of the most significant revelations made by the DCI concerns the alleged involvement of serving police officers in the murder plot.
Police said evidence obtained during the interrogation of a boda boda rider and a driver led investigators to officers attached to police posts under Kikuyu Police Station.
The DCI identified Inspector of Police Kenneth Kipkemboi Sang, the Officer-in-Charge of Nderi Police Post in Kikuyu, as the alleged link between the financiers and the operational team.
Investigators further allege that Sang was the source of the murder weapon.
He is currently on the run.
The DCI also announced the arrest of Police Constable Elijah Kibelion Kimoi, attached to Karinde Police Post, whom investigators identify as the alleged shooter.
Another officer, Constable Bett Kiplangat Collins of Thogoto Police Post, has been forensically placed at the scene and is also being sought by detectives.
Police described the alleged involvement of police officers as a grave betrayal of public trust and vowed that the Directorate would pursue all suspects regardless of rank or position.
Police disclosed that investigators are pursuing additional leads suggesting that some of the suspects involved in Dr Mutiso's murder may also be connected to the drive-by shooting of lawyer Kyalo Mbobu, which occurred on September 9, 2025, along Magadi Road.
The investigation remains active, and several other individuals who may have acted as surveillance operatives, facilitators, weapon suppliers or coordinators are still being pursued.
