Advocate Angela Mulwa and her co-accused Nelson Masiga have been released on a Sh1 million bond each by Mavoko Law Courts.
The two were freed on Wednesday after spending 14 days in police custody.
Principal Magistrate Lilian Nyabando declined a prosecution request to detain them for a further seven days, saying the initial 14 days granted were sufficient for the Directorate of Criminal Investigations to conclude investigations.
The DCI had applied to hold the duo for 21 days to complete investigations into the theft of motor vehicles linked to the murder of Dr Victoria Mutiso.
In her ruling, Nyabando said the purpose of the custodial orders had been met.
"The purpose of issuing custodial orders was to facilitate investigations. I therefore find the 14 days met the intended purpose. I therefore order that the respondents be released on bond of Sh1m each," Nyabando ruled.
The magistrate directed them to deposit their passports in court and report to the investigating officer at Mavoko SNP police station whenever required.
Nyabando noted the DPP had already received the suspects' files and was yet to decide whether to charge them.
Mulwa's lawyer Danson Omari asked the court to vary the terms and release her on Sh500,000 cash bail instead, citing difficulties processing a bond while her relatives remain in custody.
"Your honour... The three of them are behind bars, and the essence of court granting her bond terms is to allow her to exercise her freedom and liberty," Omari told the court.
The prosecution opposed both the cash bail request and the release of mobile phones and other items seized during arrest, saying they form part of exhibits.
The court will rule on the cash bail application on Thursday, August 20, 2026.
Nyabando said Mulwa would walk free if she processed the Sh1m bond before then.
Mulwa is the daughter of Rose Mbithe Mulwa, who is also a person of interest in the murder probe of Dr Mutiso, a mental health researcher and AFRIMED director, fatally shot in Nairobi's Upper Hill area in July 2026.
Four suspects have so far been arrested in connection with the case.
