A woman has been charged before a Kiambu court with allegedly giving false information to police by claiming that her child had died while being taken to hospital.
The woman appeared before Kiambu Chief Magistrate Eunice Nyutu facing five charges arising from allegations that she falsely reported the death of the child and subsequently sought official documentation based on the claim
She was charged with giving false information to a person employed in the public service, contrary to Section 129(a) of the Penal Code.
The court heard that on September 27, 2025, the woman allegedly informed a police officer that her child had died while being taken to a children’s hospital.
The prosecution alleges that she knew the information was false and intended to have the officer record the purported death in the Occurrence Book.
The charge sheet states that the woman informed the police officer that the child had died while en route to hospital, despite allegedly knowing that the information was false.
"On the 27th day of September 2025,..in Gachie Area, within Kiambu county, informed a person employed in the public service, ..as a police officer that her child namely J.A.A had died while enroute to the children's hospital, information you knew to be false, intending thereby to cause the said person to book in the occurrence book a death report of one J.A.A which he ought not to have done if the true state of facts respecting which such information was given had been known to him,” charge sheet reads.
The prosecution further alleges that she intended to cause the police officer to record a death report which he would not have made had he known the true circumstances surrounding the matter.
She faces another count of allegedly giving false information for insertion into the Register of Births, Deaths and Marriages, contrary to Section 363 of the Penal Code.
The prosecution alleges that the false information was intended to result in an official record being made concerning the purported death.
The woman is also charged with conspiracy to commit a felony, namely allegedly "obtaining a burial permit issued by an assistant chief."
The prosecution claims the alleged false report was part of a scheme to obtain official documentation relating to the purported death of the child.
She faces two additional charges under the Children Act relating to allegedly wilfully causing a child to be in need of care and protection and neglect of a child.
The charges therefore extend beyond the alleged false report, with the prosecution also accusing the woman of conduct that allegedly exposed the child to circumstances requiring protection under the law.
The woman denied all five charges when they were read to her and pleaded not guilty.
The court subsequently released the woman on a bond of Sh300,000 with a similar surety as investigations continue.
