Mukurweini MP Kaguchia at Kamukunji Police Station/COURTERSYThe High Court in Kiambu has ordered the release of Mukurweini MP John Kaguchia from police custody upon payment of a police cash bail of Sh100,000.
In orders issued on Monday, Lady Justice Njoki Mwangi directed that Kaguchia be released immediately after depositing the cash bail as his application proceeds before the court.
"The applicant shall be released forthwith from police custody upon deposit of police cash bail in the sum of Sh100,000," the court order states.
The court also directed Kaguchia to immediately serve his application on the respondents, who have been given 14 days from the date of service to file and serve their responses.
The judge further ordered that the applicant may file and serve a further affidavit within 14 days after receiving the respondents' responses, if necessary.
Justice Mwangi granted the prayers sought in paragraphs 2, 3 and 5 of the application, as well as the prayer in paragraph 4. The application, dated August 3, 2026, will be heard virtually on September 16, 2026.
The court warned that any disobedience or non-observance of its orders would attract penal consequences.
Former Deputy President Rigathi Gachagua has urged police to comply with a High Court order directing the release of Mukurweini MP.
Gachagua said the High Court had ordered Kaguchia's immediate release upon payment of the bail.
"The High Court of Kenya has ordered the immediate release of Hon. John Kaguchia from police custody upon payment of a police cash bail of Sh100,000. My advice to the OCS is to obey the court order, as he will be held personally liable for contempt of court," he said.
He added that officers should ensure they comply with court directives, cautioning that responsibility for any failure to do so would rest with the individual officer concerned.

Kaguchia was moved and detained at Kamukunji Police Station after his arrest on Monday.He was initially taken to the DCI headquarters before being transferred to the station, where his lawyers and several allied MPs have gathered.
Kaguchia was arrested after spending the night at Royal Media Services, where he had remained following a television interview amid fears that detectives were waiting to apprehend him over remarks he allegedly made on political matters.
A number of leaders accused the government of double standards in the application of the law. They claimed some leaders were targeted for political reasons.
Demonstrations have been reported in parts of Mukurwe-ini Constituency, with supporters calling for his release ahead of his expected court appearance.
