Kenol law courts in Maragua, Murang'a county/ ALICE WAITHERA
A 27-year-old man has been found guilty of attempted defilement by a Kenol court and will be sentenced on June 3.
Martin Murigi Gitau was convicted by Senior Resident Magistrate Sheila Nyaga in a case involving a minor in Makuyu, Murang’a county.
The court established that he attempted to defile the minor on October 27, 2025 at Mugira area.
The court was arrested by members of the public shortly after the incident before being frog-marched to Ciumbu police post.
Nyumba Kumi chairman Hezron Muthee testified that the minor’s mother had earlier expressed concern over the accused’s conduct and requested him to warn him against visiting her home.
Muthee told the court that on the following day, while on the way to relay the message, he found the accused already apprehended by residents over allegations of attempting to defile the minor.
He said they escorted the accused to Ciumbu police post where he was formally arrested.
The prosecution told the court that police officers responded to a commotion outside the police post and found the accused restrained by members of the public.
The court heard that the police took the suspect into custody before facilitating medical examination of the minor and recording witness statements.
According to the prosecution, the incident occurred at around 7pm when the minor’s father returned home and found the accused inside the house.
The father reportedly instructed him to return to his home but the accused allegedly became unruly leading to a commotion inside the house.
The court heard that the accused then attempted to defile the minor prompting the father to raise alarm, attracting neighbours who responded swiftly and restrained him.
In her testimony, the minor stated that the accused had previously behaved inappropriately towards her on other occasions.
In mitigation, the accused claimed that the allegations were fabricated and linked the case to a longstanding disagreement with the minor’s father whom he described as his stepfather.
