A city trader has been charged with two counts of fraud involving a Sh25 million land located in Nairobi's Eastleigh area.
Abdul Hassan Tahalil was charged before Milimani chief magistrate Lucas Onyina with forging a land document with the intention to defraud Mary Wairimu.
The charge sheet showed the offence was committed around August 10, 2022, and involved a parcel of land LR NO 36/1/18 located in Eastleigh. It is valued at Sh25 million.
“At an unknown place within the Republic of Kenya, jointly with others not before court, with intent to defraud Mary Wairimu, you forged a document of land, namely an indenture, purporting it to be genuine and valid,” the charge sheet read.
Tahalil also faced a second count of uttering a false document.
“On November 30, 2022, at the Environment and Land Court in Nairobi, knowingly and fraudulently uttered a certain forged document, namely an indenture for LR NO 36/1/18 purporting it to be genuine.”
The accused denied the charges and was granted a Sh1 million bond with an alternative cash bail of Sh500,000.
Earlier, Tahalil had challenged the charge sheet, raising objections for plea-taking before the court ruled against his objections and directed that he pleads to the charges.
Wairimu, who is the complainant in the matter, told investigators she purchased the property located in Section One along Eastleigh’s 4th Street in December 1966 for Sh56,000. However, she has recently faced persistent attempts by fraudsters who want to grab the land.
Tahalil, who is the director of Skyline Works Limited, was arrested on Thursday by detectives from the Directorate of Criminal Investigations Land Fraud Investigations Unit.
Magistrate Onyina set his case for mention on May 6, when the court will issue pre-trial directions.
