
The Director of Public Prosecutions (ODPP) has announced plans to charge former Homa Bay County officials and associates in connection with alleged procurement irregularities involving Sh348.9 million.
According to the DPP, six senior county officials are accused of irregularities in the award of a tender for the construction of the Homa Bay County Assembly office block.
The tender is reported to have been awarded to a company with links to county employees, prompting concerns about potential conflicts of interest.
The charges relate to abuse of office, willful failure to comply with procurement laws, conflict of interest, and unlawful or fraudulent acquisition of public property, under the Anti-Corruption and Economic Crimes Act, 2003.
The DPP said the decision follows the receipt of an inquiry file from the Ethics and Anti-Corruption Commission (EACC), which conducted investigations into the procurement process.
“The DPP reiterates its commitment to upholding the rule of law, promoting public interest, ensuring the proper administration of justice, and preventing the abuse of legal processes in the discharge of its constitutional mandate,” the office said in a statement.
The accused are expected to be arraigned in court as the prosecution prepares its case, highlighting the DPP’s ongoing efforts to enforce anti-corruption laws in the management of county affairs.
