Embakasi East Member of Parliament Babu Owino has issued a statement addressing an alleged incident of police brutality involving young men in Nandi County.
According to the statement, the incident occurred at around 11:51 p.m. on January 10 in the Nandi Hills area and involved officers attached to Nandi Hills Police Station.

Owino said the youths were allegedly assaulted while playing pool, an activity he described as lawful and recreational.
Details of the Reported Incident
In his statement, Owino said police officers confronted young men whose only activity at the time was playing a game. He noted that the youths were not engaged in criminal conduct but were participating in leisure activities.
He stated that the confrontation escalated into violence, with officers allegedly using force against the youths. According to Owino, the incident raised concerns about the treatment of young people by law enforcement in the area.
Position on Law and Civil Rights
Owino emphasized that playing games is notprohibited under Kenyan law. He also stated that there is no legal requirement for citizens to carry identification documents at all times and that being out at night is not in itself a crime.
He added that even in situations where a law may have been violated, police officers are required to follow due process. He said officers cannot act simultaneously as arresting agents, prosecutors, and judges.
The legislator referenced constitutional principles, including the presumption of innocence, stating that all citizens are innocent until proven guilty by a court of law.

In his remarks, Owino called for immediate action against the officers allegedly involved in the incident. He demanded their arrest and prosecution on assault charges, saying accountability is necessary to protect the rights of young people.
He stated that violence has no place in law enforcement and that policing should be guided by professionalism and respect for human rights.

Owino also addressed broader issues affecting young people in Kenya. He said many youths face economic and social challenges and that recreational activities such as sports and games provide positive engagement and help prevent involvement in crime.
He added that criminalizing such activities risks discouraging youth participation in constructive pursuits that could develop talent and create opportunities.
Appeal for Protection of Youth
In conclusion, Owino said young people deserve dignity, safety, and opportunity rather than intimidation and violence. He reiterated his call for institutions to protect, not harm, the youth.
He said the incident in Nandi should prompt a renewed focus on lawful policing practices and respect for constitutional rights as authorities review the matter.
