A businessman has been charged with obtaining Sh11.4 million in a purported cereals trading deal, with prosecutors alleging that he later acquired and used the money as proceeds of crime.
The Office of the Director of Public Prosecutions (ODPP) said the accused appeared before the Milimani Law Courts on Tuesday, October 27, and denied all three charges.
The court released him on a cash bail of Sh3 million, with two sureties of a similar amount.
According to the ODPP, the accused allegedly obtained Sh11,408,000 from another person by claiming he could buy cereals, sell them on the person's behalf and return the profits.
The alleged transaction took place between January 29 and March 17, 2026, in Nairobi's Central Business District.
The prosecution alleges that the accused made the claims knowing they were false. He was consequently charged with obtaining money by false pretences, contrary to Section 313 of the Penal Code.
But the case extends beyond the alleged transaction, with the accused facing two additional charges over what prosecutors say happened to the money.
The ODPP said the second charge relates to the alleged acquisition of proceeds of crime.
According to the charge sheet, the accused allegedly received the Sh11,408,000 into a bank account on various dates between January 29 and March 17, 2026.
The prosecution alleges that he knew or ought reasonably to have known that the money was proceeds of crime.
The third charge concerns the alleged use of the same amount held in the account.
The ODPP said the accused allegedly used the money on various dates between January 17 and March 17, 2026, in Nairobi County.
Prosecutors allege that he knew or ought reasonably to have known that the funds were, or formed part of, proceeds of crime.
The acquisition and use charges were brought under Sections 4(a) and 4(b), respectively, as read with Section 16(1)(a) of the Proceeds of Crime and Anti-Money Laundering Act.
The ODPP said the alleged offences were committed jointly with other people who have not been brought before the court.
The accused denied all three charges. The allegations remain unproven and will be subject to the court process.
