The Ethics and Anti-Corruption Commission (EACC) has recovered public land in Nyali, Mombasa, valued at Sh51 million. The land belongs to the Kenya Civil Aviation Authority (KCAA).

The 0.514-acre property, identified as MN/I/2411, was surrendered to the public following an Alternative Dispute Resolution (ADR) settlement reached on September 21, 2026, between the Commission and the registered owner, Omar Tahir.

The recovery follows civil proceedings filed by the EACC in 2009 at the Mombasa Environment and Land Court in a case involving Zakayo Kipkemboi Cheruiyot, Tahir and Sammy Mwaita.

According to the Commission, its investigations established that the property had been illegally and irregularly allocated in 2000 by the then Commissioner of Lands, Sammy Mwaita, to Cheruiyot, a former Kuresoi Constituency MP.

The Commission said Cheruiyot later transferred the property to Tahir.

The EACC said the ADR settlement followed 17 years of court proceedings and resulted in the property reverting to the public for its intended purpose.

The Commission has urged people in possession of what it describes as illegally or irregularly acquired public property to voluntarily surrender the assets to help restore public property and avoid lengthy litigation and associated costs.
