The High Court has nullified the sale of the government’s 15 per cent stake in Safaricom, declaring the transaction unconstitutional. A three-judge bench ordered the shares to be restored to State ownership, ruling that the transaction was conducted without meaningful public participation. The court also faulted the government for concealing or misrepresenting material information about the nature and effects of the sale, finding that it violated the Constitution and other laws.
