Two men have been sentenced to death by the Wajir Law Courts after being convicted of six counts of robbery with violence, the Office of the Director of Public Prosecutions (ODPP) has said.
According to a statement by the ODPP, the two were convicted by Wajir Senior Principal Magistrate Eric Malesi after the prosecution established their involvement in a series of armed robberies committed across Wajir County between 2024 and 2025.
The prosecution, led by Assistant Director of Public Prosecutions Robert Nyoro, told the court that the two men had planned and executed the robberies during the period.
The ODPP said the two were armed during the attacks and used extreme violence against their victims.
"Nyoro told the court that in the course of their criminal acts, the duo was armed and used extreme force and violence, resulting in the death of one of their victims," the statement said.
The case was supported by forensic and digital evidence, which prosecutors said placed the two men at various crime scenes.
The ODPP said digital tracking evidence linked the suspects to the locations where the robberies occurred, while CCTV footage provided further evidence connecting them to the offences.
The evidence was presented to demonstrate the involvement of the two men in the series of robberies across the county.
In his determination, Magistrate Malesi found that the prosecution had proved the key elements of the offences to the required legal standard, according to the ODPP.
The court also found that the robberies had been committed while the offenders were armed and had used extreme violence.
The magistrate said the nature of the offences warranted a deterrent sentence, taking into account the law governing robbery with violence.
“In sentencing the two, the court noted the need for a deterrent sentence in line with the law's provisions on robbery with violence,” Magistrate Malesi said, according to the ODPP statement.
The court further considered the death of one of the victims in determining the sentence.
He subsequently convicted the two men and imposed the death sentence.
“The court finds the accused persons guilty on the charges and imposes the death sentence in accordance with the law,” the magistrate ruled.
The ODPP said the ruling followed a prosecution case in which the accused faced six counts of robbery with violence contrary to Section 296(2) of the Penal Code.
The two men have been granted 14 days within which to appeal the decision.
The death sentence remains part of Kenya's law for certain capital offences, including robbery with violence.
The ODPP said the sentence was imposed after the court found that the prosecution had proved the charges against the two men to the required legal standard.
