
A man has been sentenced to 20 years in prison after being convicted of rape in Kithimani, Machakos.
According to a statement from the Office of the Director of Public Prosecutions (ODPP), the conviction was secured at the Principal Magistrate’s Court following a full trial led by Principal Prosecution Counsel James Gachoka.
The court heard from the complainant’s testimony that the incident occurred after she spent time at a local bar.
Upon leaving, the man—who was known to her—offered to take her home on his motorcycle.
"When she decided to leave, the accused, whom she knew, volunteered to take her home on his motorcycle. She accepted, expecting he would drop her off at her residence," the statement said.
However, instead of taking her to her residence, the court heard that he diverted to his house.
Once there, he locked the door, where the offence was then committed.
"The complainant stated that she resisted, but the accused overpowered her. After the ordeal, she left and reported the matter to the authorities," the statement by ODPP reads.
The ODPP stated that her account was supported by medical evidence presented in court, which confirmed the actions and injuries consistent with sexual assault.
An investigating officer also testified, explaining that the suspect was arrested after being positively identified by the complainant.
In its determination, the court found that the prosecution had proved the case beyond reasonable doubt.
Principal Magistrate Paul Wechuli ruled that the complainant’s testimony was credible, consistent and corroborated by medical findings.
The court also dismissed the defence’s claim that the accused was elsewhere at the time of the incident, noting that no evidence had been presented to support the alibi.
The magistrate further observed that the complainant’s prompt reporting of the incident strengthened the prosecution’s case.
In sentencing, the court underscored the seriousness of the offence, describing it as cruel and violent.
It noted concerns over rising cases of sexual violence against women and emphasised the need for deterrent sentences.
The magistrate further observed that such crimes cause deep physical and psychological harm and must attract deterrent punishment.
The 20-year custodial sentence was deemed proportionate to the gravity of the offence and in line with the provisions of the Sexual Offences Act.
"The accused was sentenced to 20 years imprisonment, with the court stating that the penalty was commensurate with the gravity of the offence and aligned with statutory provisions," the statement reads.
The convicted man was informed of his right to appeal the sentence within 14 days.
