A 55-year-old man has been arraigned and charged with incest contrary to Section 20(1) of Sexual Offences Act No. 3 of 2006 under the Kapenguria criminal case number E029 of 2024.
The man was charged with defiling his 12-year-old daughter on October 1, 2024, at around 7.00 pm at Sarmach village in Pokot Central Subcounty in West Pokot County.
On the second count, the accused was charged with committing an indecent act with a minor contrary to Section 11 (1) of the Sexual Offences Act, 2006.
The accused pleaded not guilty to the charges before Kapenguria Law Court Principal Magistrate Stella Telewa on Tuesday, October 15, 2024.
The accused took the plea; the court ordered that he be taken to the hospital for a mental assessment, and the medical report stated the accused was suffering from alcohol withdrawal and had mental issues.
The prosecutor told the court that the plea could be taken.
The court said the substance of the charge and every element thereof was stated by the court in the language that the accused understood.
The accused, however, pleaded not guilty to the charges.
The magistrate ordered the accused for both counts to be released on a bond of Sh200,000 with one surety.
The magistrate further ordered the case to be mentioned on October 22, 2024, for pre-trail.
