A Chinese national facing extradition to Uganda has lost a second attempt for release on bail after the Chief Magistrate’s Court at Milimani declined to release him pending determination of the extradition proceedings.
According to a statement by the Office of the Director of Public Prosecutions (ODPP), the court upheld its earlier position declining to grant the man bail after the prosecution argued that the circumstances relied upon in the previous decision had not changed.
The man is wanted in Uganda to face 30 counts of forgery and one count of theft.
In opposing the renewed bail application, the prosecution placed emphasis on the suspect's residential ties to Kenya, arguing that his short-term tenancy agreement did not demonstrate sufficiently established links to the country to justify his release.
The prosecution further argued that the man's lack of ordinary residence in Kenya, coupled with his significant international mobility, continued to present a “real and substantial risk of absconding.”
"Further, Prosecution challenged the adequacy of the proposed bail conditions, including the surrender of his passport, periodic reporting to a police station and provision of sureties," the statement said.
The state counsel argued that the circumstances that had previously led the court to deny bail remained unchanged and that there was therefore no sufficient basis to depart from the earlier decision.
The case arises from an extradition request by Uganda, where the Chinese national is wanted to face criminal charges relating to alleged forgery and theft.
The DPP said the extradition proceedings should be concluded expeditiously while the accused remains in custody, arguing that his continued detention would safeguard the process and ensure that he remains available whenever required by the court.
The prosecution was led by Senior Assistant Director of Public Prosecutions Duncan Ondimu, and Prosecution Counsel Fatma Shaban.
The ODPP said the prosecution maintained that the proposed safeguards were insufficient in light of the circumstances surrounding the accused's residence and international movements.
The court's decision means the Chinese national will remain in custody as the extradition proceedings continue.
The matter will return before the Chief Magistrate’s Court at Milimani on November 4, 2026, at 3pm for further directions.
