He is accused of assaulting a man identified as Enock Omariba in Kisii Town on November 27, 2025.

Omariba reported that the incident occurred at a restaurant where he was having breakfast with a lawyer friend.

Kibagendi confirmed that he had been arrested and later posted about the incident on his Facebook account.

In the post, he said: “I have been aggressively blocked by DCI officers and arrested, being taken to DCI HQs.”

He added that police had informed him the reason for his arrest was assault and malicious damage of property.

Police said the arrest followed approval of assault charges by the Office of the Director of Public Prosecutions.

Kibagendi was stopped in a traffic jam along Uhuru Highway and taken to Muthaiga Police Station before being moved to Kisii for possible arraignment.

The MP previously obtained anticipatory bail of Sh50,000 from Kisii High Court. Lady Justice Teresa Achieng’ Odera granted the bail on December 2, 2025, with orders prohibiting police from arresting him pending further directions.

The bail was granted following an application filed through Bonuke and Company Advocates.
