The Public Relations Society of Kenya (PRSK) has once again been dragged to court, this time over allegations of illegal overstaying in office by members of its governing council.

In a petition filed before the High Court at Milimani, PRSK member Gilbert Awino is seeking the removal of six council officials whose terms he says expired in December 2025.

Awino contends that the continued stay of the officials in office violates the society’s constitution and undermines lawful governance.

According to court documents, Awino avers that with the expiry of the six officials’ terms, the remaining three council members are unable to form a quorum to transact any lawful business.

“As it currently stands, the Council of the Respondent does not have quorum and the Respondent is therefore not in a position to carry out its mandate lawfully. The Respondent and 1st to 6th Interested Parties have failed in their duty to provide excellent governance, professionalism, to act with integrity dynamism, transparency, and accountability; further reason for this Petition. An Order of this Court is therefore necessary to ensure the Respondent’s and the Interested Party’s adherence and compliance with its own constitution in executing their mandate,” he told the court.

He further urged court to act expeditiously to avert possible crisis that's foreseeable when the term of other three council members expires.

Awino has urged the court to hear and determine the matter expeditiously, warning of a looming governance crisis should the issue remain unresolved.

He notes that the terms of the remaining three council members namely the President, Treasurer, and Assistant Secretary are set to expire in June 2026, which would leave the society without leadership.

“It is even appalling because out of the nine members of the Council, the term of six members, subject of this Petition, expired six months ago but the Interested Parties have continued staying in office. For the remaining three council members who are President, Treasurer and Assistant Secretary, their term comes to an end by June, 2026. It is therefore important that this matter is determined expeditiously so that then a crisis is forestalled when the term of the other three members expire in June, 2026,” the petition reads in part. 

The petitioner further accuses PRSK’s leadership of failing to uphold the principles of good governance, professionalism, transparency, and accountability.

He also alleges that the society has breached its own constitution by failing to conduct elections within the stipulated timelines.

Justice Bahati Mwamuye directed the responses to both the application and the opetition to be filed and served by close of on January 23, 2026.

Mention to confirm compliance and to take further directions before Mwamuye was set for February 18, 2026.
